			<content:encoded><![CDATA[<p>Kenya Urban Roads Authority (The Authority) is the State Corporation established under the Kenya Roads Act, 2007 (The Act) and charged with the responsibility for the Management, Development, Rehabilitation and Maintenance of all Public Roads [Including their reserves] in the Cities and Municipalities of the Republic of Kenya. For purposes of discharging the aforesaid responsibilities Section 10 (2) (b) of the Act confers unto the Authority powers to control urban roads reserves and access to roadside developments.<br />
Article 62 [h] of the Constitution of Kenya, 2010, deﬁnes Public land to comprise all Roads and Thoroughfares provided by an Act of Parliament. Further, Section 27 of the Act, provides that where infrastructure utility is located within a road reserve, the provider or operator of such infrastructure utility shall, upon written request by the responsible Authority, relocate such infrastructure utility to a location or alignment approved by the Authority at no cost to the Authority<br />
Pursuant further to Section 49(a) of the Act, no person is permitted to erect, construct or lay, or establish any structure or thing, on or over or below the surface of a Road Reserve or Buffer Zone unless authority therefor is granted pursuant to Regulations made under Section 46(2) (b) of the Act.<br />
It has come to the attention of the Authority and it is indeed a matter of great public notoriety that the legal provision cited above have all been serious breached and are continuously being breached by, including but not limited to, [as the case may be], erecting stone walls and permanent buildings; placing Building Material [including sand, timber and stones]; setting up makeshift wooden and/or polythene paper kiosks for purposes of hawking of  foodstuffs and groceries, including vegetables and fruits; fencing off portions thereof by use of wood and barbed wire and on which portions visibly appear ready to develop; by creating and using illegal accesses thereon; setting up and Maintaining car wash facilities; cables [ﬁbre optic, telecommunication &#038; power]; water pipes; billboards and unauthorized trenches across and along road corridors.<br />
It is hereby stated for general public notiﬁcation that the Authority calls for the immediate cessation of the breaches aforementioned and strict observance, adherence and compliance with the Law. Further information and clariﬁcation with regards thereto can be obtained from the Ofﬁce of the Director General of the Authority.<br />
The Authority is embarking on major Roads Maintenance, Rehabilitation and or Construction works affecting several urban areas including Upper-Hill roads; proposed Meru bypass, Eastleigh Roads, Outer Ring Road, Syokimau – Katani Road, South C roads, the proposed Njiru – Githurai Road, Kapsoya Road; Roads within Kakamega Municipality; Blue valley Road [Embu Municipality].<br />
PLEASE TAKE NOTICE that failure to comply as directed within reasonable time shall result in the removal of all the aforesaid class of items at the cost of the developer(s) by the Authority. Further, such acts of deﬁance shall lead to the institution of criminal prosecution against the offending party(s) in terms of Section 49[6] of the Act.<br />
